The General Terms and Conditions of the GAMBEE online store have been prepared in accordance with the Consumer Protection Act (ZVPot-UPB2), the recommendations of the Chamber of Commerce and Industry of Slovenia (GZS), and international e-commerce codes of conduct. The GAMBEE online store (hereinafter referred to as the “store”) is operated by GAMBEE d.o.o. (hereinafter referred to as the “provider”). These Terms and Conditions describe the operation of the GAMBEE online store, the rights of users, and the business relationship between the provider and the customer.

AVAILABILITY OF INFORMATION

The provider undertakes to always provide the customer with the following information:

  •     Company identity (company name, registered office, and registration number),
  •     Contact details enabling fast and efficient communication (email, telephone),
  •     Essential characteristics of goods or services (including after-sales services and warranties),
  •     Product availability (every product or service offered on the website should be available within a reasonable timeframe),
  •     Conditions of product delivery or service execution (method, location, and delivery period),
  •     Clearly and unambiguously stated prices (it must be clear whether taxes and transport costs are already included),
  •     Payment and delivery methods,
  •     Validity period of the offer,
  •     The period during which withdrawal from the contract is still possible and the conditions for withdrawal (it must be clear whether and to what extent the customer bears the cost of returning the product),
  •     An explanation of the complaint procedure, including all contact details of the responsible person or customer service department.

PAYMENT METHODS

The provider offers the following payment methods:

  •     Bank transfer to the account of the GAMBEE online store operator
  •     Payment by pro forma invoice,
  •     Payment via PayPal,
  •     Payment by VISA/MasterCard
  •     Cash on delivery.

The provider issues the customer an invoice on a durable medium, with a detailed breakdown of costs and instructions on how to withdraw from the purchase and return products, where applicable and possible.

INVOICE ISSUANCE

Upon payment for the ordered products, GAMBEE also sends the customer an invoice in PDF format to the customer’s email address. The invoice contains a breakdown of the price and all costs related to the purchase. The customer is responsible for verifying the accuracy of all information before submitting the order.

TRANSACTION AMOUNT, PRICE AND CURRENCY

All prices and the final transaction amount are irrevocable, agreed in advance, and confirmed by the signing of the sales contract by both parties, the buyer and the seller. From that moment onward, all prices and other terms are fixed and binding for both contracting parties.
The transaction amount may be denominated either in EUR or USD and does not include VAT unless explicitly stated otherwise.

RIGHT OF WITHDRAWAL AND RETURN OF GOODS

GAMBEE products are custom-made and therefore considered personalized products. All wishes, needs, and requirements are defined prior to the signing of the sales agreement; therefore, withdrawal from the contract and the return of goods are not possible.
The products are covered by a 12-month warranty, and in the event of any issues, defects, or damage, these will be remedied within a reasonable period of time.

DELIVERY TIMES AND SHIPPING

GAMBEE strives to accommodate the wishes of all customers as much as possible. Since the products are personalized, the delivery time is between 45 and 60 working days from receipt of the advance payment. If we are unable to dispatch the product within the agreed period, the customer will be notified in writing or by telephone. If the customer does not agree with the extended delivery period, they may inform us at any time via email or telephone, and we will attempt to find an alternative solution that is in the best interest of both parties.

Our quotations are generally based on the EXW Incoterm. We only arrange transportation if expressly requested by the customer.

Our shipping partners are DHL, TNT, and Pošta Slovenije. For products with more demanding logistics requirements, such as those requiring special handling due to weight, volume, or maximum dimensions, we use various freight carriers and forwarding companies.

Delivery costs are difficult to determine in advance because each delivery is customized and costs may vary significantly from case to case. Every customer order requires us to obtain a specific shipping quotation. Delivery charges are calculated according to the applicable shipping price list. The delivery price is defined at the time of ordering.

Delivery is made to the address provided by the customer when placing the order. The customer is responsible for ensuring unrestricted access for the delivery vehicle to the unloading location, namely the delivery address specified in the order. Goods are delivered to the entrance of the premises or to the nearest accessible unloading point. If access is obstructed, delivery to the entrance of the premises cannot be guaranteed.

Before the final conclusion of the contract, we provide the customer with delivery information and available delivery options (including estimated delivery time, cost, carrier, etc.). After the contract has been concluded, and as soon as possible, we provide a tracking number.

We cooperate with countries worldwide, except for those where gambling is prohibited by law according to our information. As local legislation changes, the list of countries with which we cooperate may also change.

PROCESSING OF PERSONAL DATA

Your personal data is processed by GAMBEE d.o.o. for the purpose of providing the services it offers. The company collects, maintains, processes, and stores the following user data:

  • first and last name;
  • IP address;
  • delivery address;
  • company name or legal entity name (if the user is a legal entity);
  • VAT/tax number of the legal entity (if the user is a legal entity);
  • contact telephone number;
  • email address;
  • country of residence;
  • other data voluntarily entered by the user into forms within the online store.

GAMBEE d.o.o. is not responsible for the accuracy, timeliness, or completeness of the data provided by users.
Based on your consent, the collected personal data is also used for sales analysis purposes (statistical processing, marketing research, customer segmentation, analysis of previous purchasing behavior) and for other marketing activities of GAMBEE d.o.o. (advertising in search engines and on social media platforms).

GAMBEE d.o.o. will use the collected visitor (user) data for the following purposes:
For sending pro forma invoices and invoices in the event of an order for products sold in our online store.
For maintaining customer records.
For fulfilling and delivering requested products or services.
For sending newsletters (if the individual has subscribed to receive our newsletters).

An individual may also request at any time that the controller of personal data permanently or temporarily cease using their personal data for the purposes stated above. Such a request may be sent at any time to info@gambeegaming.com, clearly specifying which consent(s) the individual wishes to withdraw.

Rights of users and customers under the GDPR
To ensure fair and transparent processing, you as a user have the following rights under applicable regulations:

Right to Withdraw Consent

Upon your request, we must provide the processed data in a structured, commonly used, and machine-readable format.

The user is also responsible for safeguarding their personal data by ensuring the security of their username and password and by maintaining appropriate software (antivirus) protection on their computer.

PROCEDURE FOR EXERCISING YOUR RIGHTS

  • I acknowledge that all of the above requests relating to the exercise of my rights concerning personal data may be submitted in writing to the controller at the email address info@gambeegaming.com.
  • I acknowledge that, for the purpose of reliable identification when exercising rights related to personal data, the controller may request additional information from me and may refuse to act only if it can demonstrate that it is unable to reliably identify me.
  • I acknowledge that the controller must respond to my request concerning the exercise of my rights relating to the above-mentioned personal data without undue delay and no later than one month from receipt of the request.

REVIEWS, OPINIONS AND RECOMMENDATIONS

Opinions, ratings, and recommendations submitted by customers form part of the functionality of the online store and are intended for the benefit of the entire user community. The Gambee online store allows any user of the online store to submit a review, which is reviewed by the provider before final publication. Gambee will not publish reviews or contributions that are offensive, inappropriate, or, in the provider’s opinion, do not provide value to other users and visitors. By submitting a review or comment, the user expressly agrees to the terms of use of their review or comment and grants the provider permission to publish part or all of the text in all electronic and other media. Gambee has the right to use the content of reviews or comments for an unlimited period and for any purpose that is in the provider’s business interest, including publication in advertisements or other marketing communications. The author of the review simultaneously declares and guarantees that they are the holder of the material and moral copyrights to the submitted reviews and comments and transfers these rights to the provider on a non-exclusive and unlimited basis.

PROTECTION OF GRAPHIC MATERIAL

LIMITATION OF LIABILITY

The provider makes every effort to ensure that the information published on its website is accurate and up to date. However, product characteristics, delivery times, or prices may change so quickly that Gambee may occasionally be unable to update the information on the website in time. In such cases, the provider will inform the customer of the changes and allow them to withdraw from the contract or replace the ordered product.

DISCLAIMER

We reserve the right to disable the website or restrict access to it due to technical issues, maintenance, or other reasons, which may also result in the inability to use the online store. In the event of technical problems affecting the website, we reserve the right to cancel orders affected by such technical errors. In the event of order cancellation, we will notify you as soon as possible and inform you of the next steps. You are responsible for ensuring appropriate protection of your equipment (antivirus protection, etc.) when accessing and using the website. The customer must ensure the security and confidentiality of the data used for website login (email address, password).

RELEASE OF LIABILITY

The provider makes every effort to ensure the accuracy and timeliness of information published in the online store. If product characteristics, availability, or prices change before the provider updates the information on the website, the provider will inform the customer of such changes and allow cancellation of the order or replacement of the ordered product. The provider strives to provide accurate photographs of products for sale; however, all photographs should be considered illustrative only. Photographs do not guarantee product characteristics. The provider collects data within the online store for the purpose of ensuring the proper functioning of the online store and providing the requested services.
The provider may also use user data for the following purposes:
• internal market research,
• informing customers about new developments in the online store,
• informing customers about new products or services offered by the provider.

RIGHT TO PRIVACY

The provider undertakes to permanently protect all personal data in accordance with the Personal Data Protection Act (Official Gazette of the Republic of Slovenia No. 86/2004) and the Insurance Act. All data obtained through the Gambee website will be used exclusively for sending informational materials and other necessary communications.

PROTECTION OF PERSONAL AND OTHER DATA

The provider undertakes to permanently protect all personal data of users. The provider will use appropriate technological and organizational measures to protect the transmission and storage of personal data, orders, and payments, thereby ensuring a secure online experience for users of the online store. Personal data collected in the online store will be used exclusively for the purpose of fulfilling orders (sending informational materials, offers, invoices) and other necessary communication.

CONSENT

By using the online store, you agree that the company may collect data in the manner and for the purposes described in these Terms and Conditions.

COMMUNICATION

The provider will contact the user via means of distance communication only if the user has not expressly objected to such communication.

COMPLAINTS AND DISPUTES

The provider will confirm receipt of the complaint within five working days, inform the user of the expected processing time, and keep the user informed throughout the procedure. The provider will make every reasonable effort to resolve any disputes amicably. If a dispute is resolved through court proceedings, the competent court shall be the Local Court of Koper.

UPDATING THE TERMS AND CONDITIONS

The website owner reserves the right to amend these Terms and Conditions without prior notice. Changes become effective immediately upon publication.
